Návrh stanoviska FDE k iniciatíve EK umožniť členským štátom

zakázať alebo povoliť vstup komodít na báze poľnohospodárskych GMO na svoje územie

 

FoodDrinkEurope predložil na pripomienkovanie svoj návrh stanoviska (viď. nižšie), v ktorom odmieta iniciatívu EK. Odmietnutie je odôvodnené tromi základnými argumentmi:

  • absencia dopadovej štúdie;
  • veľmi problematická implementácia iniciatívy;
  • právna neistota.

K návrhu sa môžu vyjadriť všetci členovia FDE a v konečnom dôsledku sa bude o ňom hlasovať na plenárnom zasadaní 15. novembra 2015.

Dear all,

 

Please see in below, Giovanni La Via’s draft report which suggests rejecting the Commission proposal for a regulation on the possibility to restrict use of GM food and feed on their territory.

The Rapporteur on the proposal, Giovanni La Via (EPP, Italy), suggests to reject the proposal on the following grounds:

(1) Absence of impact assessment

According to the Rapporteur, the fact that the Commission did not carry out an impact assessment before presenting the proposal conflicts with the "Better Regulation" and "Transparency" principles. The Rapporteur is of the view that the proposal could have far-reaching consequences for the functioning of the Internal Market for food and feed and for the competitiveness of the EU agricultural market, since the EU agricultural sector is highly dependent on the supply of proteins from GM source.

(2) Implementation of the proposal

The Rapporteur underlines that the proposal would be almost impossible to implement, since border controls no longer exist within the EU's agricultural sector. According to him, the re-introduction of such controls would reverse the economic achievement of the Single Market.

(3) Legal certainty

According to the Rapporteur, the proposal would not ensure the necessary legal certainty and adequate tools for Member States that want to restrict or prohibit the use of GM food and feed on their territory in accordance with the Internal Market and World Trade Organisation (WTO) trade rules. In addition, the Rapporteur stresses that the proposal does not provide any definition of the term "use".

 

Timetable:

  • Member State representatives of the Council Working Party of Agricultural Attachés are scheduled to discuss the proposal during a meeting to be held on 2 July 2015.

•        Deadline for amendments: 16 September  2015

•        Vote in committee: 12 October 2015

•        Plenary sitting: 24 November  2015
